Terms of Service

1. Acceptance of terms

By downloading, installing, or using Evolv Journal (the "app"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the app. These Terms govern your use of the app made available by the developer ("we," "us") at evolvjournal.app.

2. Eligibility

You must be at least 13 years old to use Evolv Journal. By using the app you represent that you meet this requirement. If you are under the age of majority in your jurisdiction, a parent or legal guardian must review and accept these Terms on your behalf.

3. Your account

You create an account using your email address and a one-time sign-in code. You are responsible for keeping your account secure. Notify us immediately at support@evolvjournal.app if you suspect unauthorised access. We are not liable for losses caused by unauthorised use of your account.

4. Subscriptions and in-app purchases

4.1 Evolv+ subscription

Evolv+ is an optional subscription that unlocks full history access, deeper weekly insights, and other premium features. Evolv+ is available as a monthly or yearly subscription. Pricing is displayed in the app at the time of purchase and may vary by region.

4.2 Free trial

The yearly Evolv+ plan includes a 7-day free trial for new subscribers. Your free trial begins when you confirm the subscription. At the end of the 7-day free trial, your subscription will automatically renew and you will be charged the yearly subscription price unless you cancel before the trial ends.

4.3 Auto-renewal disclosure (Apple StoreKit requirement)

Evolv+ subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current subscription period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscription at any time by going to your iPhone Settings → [Your Name] → Subscriptions, or by tapping Manage Subscription in the Evolv Journal Settings screen.

Subscription prices may change. If a price increases, Apple will notify you and require your consent before charging the new price.

4.4 Refund policy

All purchases are processed by Apple through the App Store. Refund requests are handled exclusively by Apple under their standard refund policy. To request a refund, visit reportaproblem.apple.com. We are unable to issue refunds directly.

4.5 Feature availability

We may add, modify, or remove features from the free or paid tiers over time. We will give you advance notice of material changes that remove functionality you currently pay for. Where required by law, we will provide adequate notice before any such change takes effect.

5. Your content

You retain ownership of all content you create in the app — photos, journal entries, notes, and routine data. By using the app you grant us a limited licence to store and process your content solely to provide the service to you. We will never sell, license, or share your content with third parties for advertising or any commercial purpose.

You are responsible for the content you upload. You agree not to upload content that is illegal, harmful, or that you do not have the right to use.

6. Acceptable use

You agree not to:

• Use the app for any unlawful purpose or in violation of any applicable law
• Attempt to gain unauthorised access to any part of our systems or other users' data
• Reverse-engineer, decompile, or disassemble the app except as permitted by law
• Use the app in any way that could damage, disable, or impair our servers or networks
• Scrape, copy, or redistribute any part of the app without our written permission

7. Intellectual property

Evolv Journal, its name, logo, design, and all original content (excluding your personal journal content) are our intellectual property or that of our licensors. Nothing in these Terms grants you any right to use our trademarks, trade names, or other intellectual property without our prior written consent.

8. Disclaimer of warranties

The app is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the app will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that any results obtained from using the app will be accurate or reliable.

Evolv Journal is a personal journaling tool. It does not provide medical advice, diagnosis, or treatment. Nothing in the app constitutes professional medical advice. Always consult a qualified healthcare provider for any health concerns.

9. Limitation of liability

To the fullest extent permitted by applicable law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, revenue, or profits — arising out of or in connection with your use of or inability to use the app, even if we have been advised of the possibility of such damages.

Our total cumulative liability to you for any cause arising out of these Terms or your use of the app will not exceed the total amount you paid us (via Apple) in the twelve months preceding the claim, or INR 500 / USD 6 if no payment was made.

10. Termination

You may stop using the app at any time. You may delete your account from Settings → Delete account in the app. Upon deletion, your data is removed within 30 days as described in our Privacy Policy.

We reserve the right to suspend or terminate your access to the app if you materially breach these Terms and fail to remedy the breach within 14 days of notice. We will not terminate your access without cause. Termination does not entitle you to a refund; refund eligibility is governed by Apple's policy (§4.4 above).

11. Changes to these terms

We may update these Terms from time to time. The "Effective" date at the top of this page tells you when the current version took effect. For material changes, we will notify you in the app or by email at least 30 days before the change takes effect. Continued use of the app after the effective date constitutes your acceptance of the revised Terms.

12. Governing law and disputes

These Terms are governed by the laws of Karnataka, India, without regard to its conflict-of-law principles. Any disputes arising under these Terms will first be addressed informally — please contact us at support@evolvjournal.app and we will try to resolve the issue within 30 days. If informal resolution fails, disputes will be subject to the exclusive jurisdiction of the courts of Bangalore, Karnataka, India.
